These Terms and Conditions govern your use of maddrelldesign.com and the design services and products provided by Maddrell Design (“we”, “us”, “our”). By using our website or engaging our services, you agree to these Terms.
1. About Us
Maddrell Design is a one-person design studio operated by Alister Maddrell, based in Sydney, New South Wales, Australia. You can reach us at hello@maddrelldesign.com.
2. Our Services
We provide design services and digital products, including:
Website Build: a complete, fixed-scope website project from strategy through to launch.
Care Plan: an ongoing monthly aftercare subscription covering hosting management, monitoring, updates and backups, small change requests (one active at a time, most delivered within 2 business days) and priority support.
Digital products: templates and components sold through our store and the Framer Marketplace.
The exact scope of any project or subscription is agreed with you before work begins.
3. Quotes and Pricing
Prices are shown in Australian dollars and inclusive of GST unless stated otherwise. Website Build projects are priced by scope: Landing from AUD 1,800, Marketing Site from AUD 2,500, and Site + CMS from AUD 5,500 — founding prices honoured for our first two clients per tier, with the standard rate (AUD 2,500 / AUD 5,500 / AUD 9,500 respectively) applying from the third client onward. The final price is set after a consultation. The Care Plan subscription is AUD 179 per month. Published prices may change, but any price agreed for your engagement is honoured for that engagement.
4. Payments and Subscriptions
The following terms apply to payments:
Project work: fixed-scope projects may require a deposit before work begins, with the balance due as agreed.
Subscriptions: the Care Plan subscription is billed monthly in advance. You can pause or cancel at any time, effective from the next billing cycle.
Processors: payments are processed securely by Stripe and Lemon Squeezy.
Refunds: because work is delivered on a rolling basis, fees already paid for time worked or for a current billing period are non-refundable.
5. Your Responsibilities
To help your project run smoothly, you agree to provide accurate information, supply the content and materials we need, and give timely feedback and approvals. You confirm that you own or have the right to use any materials you provide to us.
6. Intellectual Property
Your work: on full payment, ownership of the final design deliverables we create specifically for you transfers to you.
Our materials: any tools, source files, templates, and components we reuse across clients remain our property. Digital products are licensed to you, not sold.
Portfolio: unless we agree otherwise, we may display completed work in our portfolio and marketing.
Reservation of rights and reuse. We retain ownership of all underlying frameworks, templates, components, design systems, code, and reusable methods we use to deliver a project. On full payment, you receive ownership of (or a licence to) the final delivered website and its bespoke, client-specific content. We may reuse, adapt, and commercialise the non-client-specific underlying work, including in our own templates and products, provided we do not reproduce your brand identity, copy, photography, or other proprietary content.
7. Revisions and Turnaround
For the Care Plan subscription, we work on one active request at a time, with most deliverables returned within two business days depending on scope. Revisions are included until the request is right, within the agreed scope.
8. Disclaimers
Our services and products are provided with reasonable care and skill, but “as is” in respect of specific outcomes. We do not guarantee any particular business result, ranking, or revenue from the work we deliver.
9. Limitation of Liability
To the fullest extent permitted by law, our total liability arising from our services is limited to the amount you paid us for the work giving rise to the claim. We are not liable for any indirect or consequential loss. Nothing in these Terms excludes rights you have under the Australian Consumer Law.
10. Termination
Either party may end an engagement with reasonable notice. You remain responsible for fees for work completed up to the date of termination. We may suspend or end services if these Terms are breached.
11. Governing Law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
12. Changes to These Terms
We may update these Terms from time to time. Any changes will be posted on this page with a revised date at the top. Continued use of our website or services means you accept the updated Terms.
13. Payments, deposits and refunds
All prices are in Australian dollars and inclusive of GST. Website Build projects require a 50% deposit to begin on every tier, with the balance invoiced on completion and due within 14 days (Net-14). Deposits are non-refundable once work on the project has begun. Care Plan subscriptions are billed monthly in advance; you may cancel within the first week of a billing month for a refund of the remaining three weeks, after which the current month is non-refundable and the subscription does not renew.
